Blood Alcohol Content & DUI in Florida

St. Lucie & Port St. Lucie DUI Defense Lawyer

When a person is stopped and investigated by law enforcement for DUI (driving under the influence) they may be asked to submit to a blood test to measure BAC (blood alcohol content). When a person has blood alcohol content at or above 0.08% they can be charged and arrested for DUI in St. Lucie, Florida. However, there are instances in which a person may have a lower BAC and still face a DUI arrest. These include a person operating and driving a commercial vehicle with a BAC at or above 0.04% and a person under the age of 21 with a BAC as low as 0.02%.

What is BAC?

Blood Alcohol Content (BAC) refers to a person’s blood alcohol ratio. Each person may have a different BAC reading even if they consumed the same type and amount of alcohol. A person has their own special body chemistry in which their own physical condition, gender, weight, metabolism and digestion all play a huge factor in whether or not they become intoxicated. In addition, the amount of sleep, food, medication and drinks a person may have had, or not have had prior to ingesting and consuming alcohol can also affect the outcome of a blood test. The percentage of alcohol in a drink also plays a huge factor as to whether or not a person will become drunk after just one or more drinks.

There are several legal defense strategies which may be presented when a person is charged and arrested for DUI, all stemming from blood alcohol content testing:

  • Improper Administration of Blood Test
  • Improper Training/Education of Lab Personal
  • Contamination of Sample
  • Mix up of Blood Test
  • Fermentation of Blood Sample
